Legal competence and etiquette: formation of a flexible management culture in the context of educational transformation

Abstract

The article considers the change in the management model in the educational system, the transition from traditional administration to service leadership, which is due to constant changes in the demands of society and the growing independence of educational organizations. The authors have analyzed the legal competence of a manager as an integral quality, which includes knowledge of the regulatory framework, the ability to apply legal norms in non-standard situations, an understanding of the legal foundations of working with staff and possession of tools for legal influence on organizational culture. The concept of business etiquette is considered, which in the service management model is not just an external attribute of the position, but becomes a mechanism for the implementation of legal and moral norms in the daily practice of management. The article also examines the regulatory, preventive, reputational and integrative functions of business etiquette and the specifics of its manifestation in the educational environment, which is associated with the publicity of the leader’s activities, work with minors, interaction with parents and government agencies. The novelty of the research lies in substantiating the correlation between legal competence and business etiquette as the basis of a flexible management culture, as well as in identifying the mechanism of «packaging» a legal norm into an ethically correct form of a management decision. The authors conclude that the managerial activity of the head of an educational organization should combine legal competence and etiquette culture.
